Possession with Intent to Distribute Drugs or Distribution of Drugs


The crime of knowingly or intentionally distributing or possessing with intent to distribute a controlled substance.

The maximum penalty is 2 years in a county house of correction and/or a fine of $500 or 10 years in a state prison and/or a fine of $10,000. In order to prove that the Defendant is guilty of Possessing with Intent to Distribute or Distributing Drugs, the prosecutor must prove 3 things beyond a reasonable doubt:

  1. That the substance in question is a controlled substance.
  2. That the Defendant possessed some perceptible amount of that substance with the intent to distribute it to another person or distributed some perceptible amount of that substance to another person.
  3. That the Defendant did so knowingly or intentionally.
