Does Returning Property Make a Larceny Charge Go Away in MA?
No. Returning property does not automatically make a Massachusetts larceny charge go away.
In a larceny case, an important question is what happened when the property was allegedly taken or converted and whether the Commonwealth can prove the required criminal intent. Giving the property back afterward does not automatically erase what the prosecution claims happened earlier.
Returning property or paying restitution may still become relevant when a case is being resolved. It may affect negotiations, the alleged victim’s position, or other practical considerations. However, it should not be confused with a guaranteed dismissal.
It is also important to be careful about statements made while attempting to return property. An apology, text message, payment agreement, or explanation could potentially become evidence and may be interpreted differently than intended.
For more information about the underlying offense, see our larceny charges page.
If you have been accused of taking property and are considering returning it, paying restitution, or communicating with the complaining witness, it may be wise to discuss the situation with an attorney first. Contact us to discuss your case.
